Divorce for non-Muslim couples in Malaysia is governed by the Law Reform (Marriage and Divorce) Act 1976 ("LRA 1976"), and petitions are filed in the High Court.
This article sets out when a divorce petition may be filed, the two routes available under the LRA 1976, and the orders the court makes on children, maintenance and matrimonial assets.
Section 50 of the LRA 1976 provides that no petition for divorce may be presented within the first two years of marriage, unless the court grants leave on the ground of exceptional circumstances provided under the LRA 1976 or hardship suffered by the petitioner, for example, where there is serious abuse.
The court must also have jurisdiction. In general terms, this is satisfied where the parties are domiciled in Malaysia at the time the petition is presented. Where one party resides abroad, jurisdiction should be confirmed with your solicitor before filing.
Where both spouses agree to the divorce and to its terms, they may present a joint petition under section 52 of the LRA 1976. The parties must have reached agreement on the arrangements for the children, maintenance, and the division of matrimonial assets. No ground for the breakdown of the marriage needs to be proved, and the compulsory conciliation process does not apply.
The court's function is to satisfy itself that both parties freely consent and that proper provision has been made for the wife and the children. If satisfied, the court grants a decree nisi, which is made absolute three months later. An uncontested joint petition is ordinarily completed within four to six months of filing, making it the fastest and most economical route.
Where consent or agreement on terms is absent, one spouse may present a single petition. Two additional requirements arise.
Reference to the conciliatory body. Section 106 of the LRA 1976 requires the petitioner to first refer the matrimonial difficulty to a conciliatory body in practice, the marriage tribunal of the National Registration Department (JPN). A petition may only be filed once the tribunal certifies that reconciliation has failed. This requirement is dispensed with in defined situations, including where the respondent's whereabouts are unknown, the respondent resides abroad and is unlikely to return within six months, is imprisoned for a term of five years or more, suffers from an incurable mental illness, or refuses to attend the tribunal.
Proof of irretrievable breakdown. Under sections 53 and 54 of the LRA 1976, the petitioner must prove that the marriage has irretrievably broken down by establishing one or more of the following facts:
A contested petition typically takes nine to twelve months, and longer where custody or substantial assets are in dispute. In practice, many contested matters are resolved by negotiation and concluded on agreed terms before trial.
The court deals with the consequences of the divorce in the same proceedings:
Custody of children : orders on custody, care and control, and access under section 88, with the welfare of the child as the paramount consideration. This topic is addressed in our companion article on child custody.
Maintenance of the spouse : under section 77, assessed primarily on the means of the paying party and the needs of the recipient.
Maintenance of children : the duty ordinarily continues until the child attains 18, and, following the amendments in force from 15 December 2018, extends where the child is pursuing further or higher education or training (section 95).
Division of matrimonial assets : under section 76 as amended, the court has regard to financial contributions, contributions to the welfare of the family by looking after the home or caring for the family, debts incurred for the parties' joint benefit, the duration of the marriage, and the needs of minor children.
Conclusion
The route a divorce takes and its cost, duration and toll on the family is determined largely by whether agreement can be reached on the practical terms. Where agreement is possible, a joint petition provides certainty within months; where it is not, the LRA 1976 provides a clear framework for the court to resolve matters. In either case, the terms relating to children, maintenance and assets deserve as much attention as the divorce itself, as they are considerably harder to revisit later.
